Some aspects of Daniel Culling's life. This is the last will and testament of me Daniel CULLING of Alpington in the County of Norfolk farmer being of sound and [disposing?] mind memory and understanding made in manner following (that is to say)
* First I do nominate constitute and appoint Joshua CHITTOCK of Poringland in the same county farmer and Clement CHITTOCK of Saxlingham in the same county farmer executors of this my last will and testament. Also I give and bequeath unto the said Joshua CHITTOCK the sum of ten pounds and to the said Clement CHITTOCK the sum of five pounds for their care and trouble in the said executorship.
* Also I give and bequeath unto Susan my wife to and for her own use all such part or parts and so much of my household stuff plate china linen bedding and furniture as she shall choose the same to be valued and appraised by two indifferent persons one to be chosen by my said wife and the other by my said executors and not to exceed the value of 5 pounds.
* I also give and bequeath unto them my said executors their executors administrators and assigns All and every Messuages Lands and Hereditaments whatsoever and wheresoever which I shall hold or be possessed of at my decease under or by virtue of any lease or leases or as tenant from year to year. And also all and singular my household stuff and furniture dairy and brewing utensils (except what I have hereinbefore given to my said wife) Farming Stock cattle corn grain hay horses ploughs carts wagons and implements of husbandry and other produce upon my said farm and premises upon trust to carry on the farming business I shall be in at my decease in the best and most advantageous manner they can as long as they my said executors shall in their discretion think proper and the clear profits arising therefrom to pay and apply as hereinafter mentioned. And my will is that whenever my said executors shall think proper to give up my said farming business then I do hereby authorize and direct them to sell all the aforesaid [leaselide heiditaments] and also all the household stuff and furniture dairy and brewing utensils (except as before excepted) farming stock cattle corn hay and implements of husbandry and other produce then upon my said farm and premises for the best price and prices that can be gotten for the same. And as to the money arising from the said sale or sales (whenever the same shall take place) and the rest and residue of my other goods chattels ready money and securities for money and personal estate whatsoever which shall remain after payment of my debts the above legacies and my funeral expenses I give and bequeath the same unto my said executors upon trust to place the same out at interest on such security and securities as shall be though good and sufficient for the same until the same shall be payable by this my will and as to the clear profits arising from my said farming business and the interest arising from the money I leave herein direct to be placed out at interest I will and direct that the same and such part and parts of the principal money as shall in the discretion and opinion of my said executors be necessary shall be by them my said executors paid laid out and expended in for and towards the maintenance and support of my said wife during so long time as she shall continue my widow and no longer or until my youngest child born and to be born shall attain his of her age of twenty one years and in for and towards the maintenance education and bringing up of all my children for so long time as my said executors shall in their discretion and opinion think they want od stand in need in need of the same or the youngest of my children shall attain the said age of twenty one years and as to the money arising by sale of my aforesaid household [hereditaments] (in case the same be sold) furniture (except as before excepted) farming stock implements of husbandry and other produce upon my said farm and premises and by and out of my personal estate or such part or parts of the said monies (if any) as shall not have been paid laid out and expended in for and toward the maintenance and support of my said wife ad the maintenance education and bringing up of all my children as hereinbefore mentioned I give and bequeath the same unto my said wife (if she shall then be my widow but not otherwise) and all my children born and to be born equally to be divided between them share and share alike to be paid to them when my youngest child shall attain the age of twenty one years. And in case any of my children shall depart this life before thay shall had and received their respective parts or shares of my personal estate leaving a child or children of their respective bodies lawfully begotten then my will is that such children (if more than one) share and share alike and if but one that such only child shall be entitled to and be paid and receive the part or share or parts or shares (if any) of his her ot their deceased parent at his or their age or respective ages of twenty one years and the said share and the interest money to be made of the same in the mean time shall be applied towards his ot her maintenance and support. And my will is and I do hereby direct that my said executors shall each of them to answerable for his own act and receipt only and not the one for the other of them. And that they shall not be answerable for any loss or miscarriage that may happen in my estate and effects so as the same happens without their willful neglect or default and also that they shall or may retain all their costs charges damages and expenses and fees to counsel for advice out of the estate and effects vested in them in and by this my will. And I do hereby revoke all former wills by me at any time made and declare this only to be my last will and testament in writing whereof I the said Daniel CULLING the testator have to this my last will and testament contained and written in three sheets of paper together annexed set my hand and seal (that is to say) to the two first sheets thereof my hand and to this third and last sheet thereof my hand and seal this fourteenth day of January in the year of our Lord one thousand either hundred and nineteen.

The will was proved by the executor on the 30th day of October 1819 before the Reverend James William NEWTON, clerk Surrogate to the Worshipful Thomas HAY

The amount left was under 450 pound.

* I believe this is the will of the Daniel CULLING who was buried in St Mary the Virgin Yelverton, whose abode was Alpington when he died on 12th May 1819. He was said to be a married man aged 26.
* The Joshua CHITTOCK executor is his brother-in-law and Clement CHITTOCK is Joshua's brother.

Estates Planned & Unplanned

John Culling left a will on 13 July 1813 in Norwich, Norfolk, England, in which Daniel Culling was a beneficiary; excerpt of the will -- P119; "... bequeath the same unto ten of my children (that is to say) Mary the wife of William Ebden, James Culling, Elizabeth the wife of the said James Shreeve, Sarah the wife of the said Joshua Chittock, Hannah the wife of William Reeder, the said Ann and Lydia, Honor the wife of Sheering FLATMAN and Daniel CULLING equally to be divided between them share and share alike. You will note that even though he says 10 children he only names 9. John and Isaac (missing from this list) are both named in earlier clauses. 2 Grandsons, sons of James also get a mention. One is named as James, and I do not yet have him as part of his family, so this will need researching further. In the mean time I have added him without any confirming parish records.

Research Notes

  • Research note 01: There was a death of a young child Charlotte (22 weeks) on 7th January 1819. This child was the daughter of Daniel and Susan nee WALLER, and is buried in the same churchyard.
    * Daniel and Susan were married in Great Poringland 25th Dec 1811, and it was the first marriage for both. The marriage was witnessed by Robert WALLER and Harriett RICHES.
    * Daniel's age at death makes his year of birth 1792 or 1793. There was a Daniel christened in Yelverton 17th August 1792. He was the son of John and Lydia CULLING nee PARSONS. He was born 7th July 1792..
